Article 1 Definitions

Thomasmulder.com (hereinafter: Thomasmulder.com) are the websites and trading names of Thomasmulder.com, and aims to offer online courses and other digital products, all in the broadest sense.

In these General Terms and Conditions ‘Customer’ means: the natural or legal person or the partnership of natural and / or legal persons or the agent or representative acting on their behalf who uses the Services of Thomasmulder.com and Thomasmulder.com gives the order to provide Services as referred to in paragraph 4 of this article.

In these General Terms and Conditions ‘Agreement’ means: the legal relationship between Thomasmulder.com and the Customer, all in the broadest sense.

In these General Terms and Conditions ‘Services’ are defined as: all products and services Thomasmulder.com and/or third parties engaged by Thomasmulder.com delivered to the Customer, including providing access to purchased Programs on the Platform, as well as all other activities Thomasmulder.com performed for the Customer, of any nature, performed within the context of an assignment, including activities that are not performed at the express request of the Customer.

In these General Terms and Conditions, ‘Subscription’ means: a long-term agreement made between Thomasmulder.com and Customer, whereby the Customer obtains access to a Program for the duration of the agreement.

In these General Terms and Conditions ‘Website’ means: the Websites www.Thomasmulder.com.nl.

In these General Terms and Conditions, ‘Program’ means an online course provided by Thomasmulder.com and purchased by Customer under an Agreement.

In these General Terms and Conditions, ‘Platform’ means the online platform on which the Customer can find their purchased Programs.

Article 2 Applicability of the General Terms and Conditions

These General Terms and Conditions apply to all Agreements concluded between Customer and Thomasmulder.com whereby Thomasmulder.com offers Services or provides products. The General Terms and Conditions apply accordingly to Subscriptions, unless otherwise provided in Article 9.

Deviations from the General Terms and Conditions are only valid if expressly agreed with Thomasmulder.com in writing.

Applicability of purchase or other conditions of the Customer is expressly rejected, unless expressly agreed otherwise in writing.

The General Terms and Conditions also apply to additional or changed orders of the Customer.

Article 3 The Agreement

All offers on the Website are entirely without obligation, unless explicitly indicated otherwise.

The agreement is made by accepting the offer of Thomasmulder.com by the Customer. This is done by purchasing one of the offered products and/or Services via the Website.

If Thomasmulder.com sends a confirmation to the Customer, it is decisive for the content and interpretation of the Agreement, subject to obvious errors. Thomasmulder.com cannot be held to its offer if the Customer can reasonably understand that the offer, or a part thereof, contains an obvious mistake or error.

If the acceptance (whether or not on minor points) deviates from the offer included in the quotation, Thomasmulder.com is not bound by it. The contract will not be concluded in accordance with this deviating acceptance, unless Thomasmulder.com confirms the deviations in writing.

Article 4 Execution of the Agreement

Thomasmulder.com will make an effort to perform the Services to the best of his insight and ability.

Thomasmulder.com has the right to have certain activities performed by third parties. When hiring third parties, Thomasmulder.com will take the necessary care and consult with Customer in the selection of these third parties, as much as this is reasonably possible and usual in the relationship to Customer. The costs of hiring these third parties will be borne by Customer, and will be charged by Thomasmulder.com to Customer.

The Customer shall ensure that all data, which Thomasmulder.com indicates to be necessary or which the Customer should reasonably understand to be necessary for the execution of the Agreement, shall be provided to Thomasmulder.com in a timely manner. If the information necessary for the execution of the Agreement is not provided to Thomasmulder.com in time, Thomasmulder.com has the right to suspend the execution of the Agreement.

Thomasmulder.com reserves the right to make changes to the Programs or the Platform. This is also possible when the Agreement has already been entered into, provided that the changes do not interfere with the proper performance of the Agreement.

If a term has been agreed upon or given for the performance of Services, this is never a deadline. When exceeding a term, the Client should give Thomasmulder.com a written notice of default. Thomasmulder.com should be offered a reasonable period to still fulfill the Agreement.

Article 5 The platform

When entering into an Agreement concerning the purchase of one or more Programs, the Customer will receive access to the Platform, where the purchased Programs can be found. The Customer will have access to the Platform for as long as they have an account. The right to access ends when:

the Agreement is dissolved; or

The Customer wishes their email address to be deleted by Thomasmulder.com; or

Thomasmulder.com considers it necessary for any other reason to temporarily or permanently deny the Customer access to the Platform. In this case, the Customer will be informed by Thomasmulder.com of the reason for being denied access.

Some parts of the Programs or the Platform require an additional purchase. If the Customer makes purchases within the Platform, a new agreement is entered into between him and Thomasmulder.com for this purpose.

The Platform may offer products and / or services from third parties, which allows visitors to enter into an agreement with these third parties through the Platform. Thomasmulder.com is not responsible for the content and / or implementation of these agreements and refers to the General Terms and Conditions of the third parties involved. Thomasmulder.com does not become a party to the agreement between the customer and the third party in any way.

Article 6 Suspension, dissolution and interim termination of the Agreement

Thomasmulder.com is authorized to suspend the fulfillment of the obligations, if the Client does not, not completely or not timely fulfill the obligations from the Agreement, or that Thomasmulder.com has good reason to fear that the Client will fail in these obligations.

If the Customer does not comply with his obligations resulting from the Agreement and this non-compliance justifies the termination, Thomasmulder.com is entitled to terminate the Agreement immediately and with immediate effect without any obligation on his part to pay any compensation or indemnification, while the Customer, by virtue of default, is obliged to pay compensation or indemnification.

Furthermore Thomasmulder.com is authorized to terminate the Agreement if circumstances arise of such nature that fulfillment of the Agreement is impossible or unchanged maintenance of the Agreement can not reasonably be required.

Article 7 Cancellation

Cancellation is possible within fourteen 14 days after purchase under certain conditions(*).

Cancellation must be made in writing and explicitly confirmed by Thomasmulder.com. The customer must write an email to support@thomasmulder.com.

CONDITIONS:

*Customer has not watched more than one video from the course

If the customer wishes to cancel the purchase within 14 days, the customer will get a refund minus the setup-fee. The setup-fee amounts €1000,- excl. VAT. If the customer has opted for installment payments and has not yet paid more than €1000,- as a result, Pinterest Mastery B.V. will invoice the remaining amount to reach a total amount of €1000,- excluding VAT.

Article 8 Costs, fees and payment

All amounts mentioned on the Website are in Euros and include VAT, unless stated otherwise.

Thomasmulder.com has the right to correct manifestly erroneous errors in the quotation.

Payment is made by credit card, PayPal or iDEAL via the Website. If the Customer pays by credit card and reverses the amount paid, this will result in an automatic termination of the Agreement and a denial of access to the purchased Program.

In some cases it is possible to pay in installments. When this is a possibility, it is indicated on the Website for the relevant Services or products.

The Customer has the duty to notify Thomasmulder.com immediately of any inaccuracies in the payment details stated or provided.

Article 9 Subscriptions

Thomasmulder.com offers with some products payment per Subscription. Customer has the choice between a monthly subscription (with a duration of 1 month) or if available a quarterly subscription (with a duration of 3 months).

The Subscription will automatically renew for the duration of one term upon expiration.

When purchasing the Subscription, payment is made directly via iDEAL or credit card. The customer authorizes Thomasmulder.com with each automatic renewal of the subscription to write off the agreed amount via an automatic collection.

Article 10 Liability

The Customer is responsible for providing correct and representative data and information necessary for the execution of the Agreement. Thomasmulder.com is not liable for damages if the Customer has provided incorrect, unrepresentative or irrelevant data.

Thomasmulder.com is not liable for errors or omissions of third parties engaged by it. By using the Services of Thomasmulder.com, the Client authorizes Thomasmulder.com, if a third party engaged by Thomasmulder.com wishes to limit its liability, to accept that limitation of liability also on behalf of the Client.

Thomasmulder.com will not be liable for any errors on the Website.

Thomasmulder.com is not liable for the accessibility of the Platform.

Thomasmulder.com is not liable for indirect damages, including but not limited to consequential damages.

Thomasmulder.com is not liable for not or not timely fulfilling the obligations, arising from the Agreement, in case this is caused by force majeure as referred to in Article 10.

The Client indemnifies Thomasmulder.com against claims from third parties, of any nature, which are related to the Services.

If Thomasmulder.com is held liable, it will only be liable for direct damages actually incurred, paid or suffered by the Customer due to a demonstrable failure of Thomasmulder.com in relation to its Services.

The liability of Thomasmulder.com is limited to the amount covered and paid out by the insurer. If the insurer does not pay out, or if Thomasmulder.com is not insured, the liability is limited to the amount paid by Customer.

The limitation of liability as described in this article does not apply if there is intent or conscious recklessness on the part of Thomasmulder.com.

This provision does not exclude liability insofar as liability may not be limited or excluded by law.

Article 11 Force Majeure

Force majeure” is defined as: all external causes, beyond the will or control of Thomasmulder.com, due to which timely, complete or proper fulfillment of the Agreement is no longer possible.

Force majeure as meant in the previous paragraph includes, but is not limited to: non-compliance of a third party, illness or death of Thomasmulder.com staff or a third party, abnormal weather conditions, disruptions in water and energy supplies, strikes, serious disruptions in the systems of Thomasmulder.com, fire, floods, natural disasters, riots, war or other domestic disturbances.

In case of force majeure, fulfillment of the Agreement will be suspended as long as the force majeure persists.

Article 12 Guarantee

12.1 Coaching programs

  1.  If the User is not satisfied with the result obtained by him, the User may file a complaint up to 5 working days after the end of the first one-month subscription period. In this complaint, the User must prove, with reasons and by producing evidence, that he has not achieved any result. By no result is meant: the User has not made any sale and he has not generated any turnover (€ 0) during and 14 days after the end of the first subscription period.
  2. Any refund of the subscription fee will be refunded only if the User has expressly fulfilled all the following conditions. Thomasmulder.com must access the data it has requested from the User upon first request. If the User refuses to grant access or does not provide access or the requested data within the deadline of 7 working days, the User will not be entitled to a refund of any funds.
  3. If thomasmulder.com has granted access, the following requirements must be (fully) met: -The User has fully gone through the content from the course and documentary evidence shows that this content has been correctly applied by the User. -The User has attended at least two group coaching sessions in the first 30 days. -The User has spent at least 500 euro on marketing activities (Pinterest Ads).
  4. If the complaint is insufficiently substantiated, or in thomasmulder.com’s sole judgment there is no reasonable ground for the complaint, the User will not receive a refund. If, in thomasmulder.com’s sole opinion, there is a justified complaint, the User will receive a refund of the money already paid within 10 days. Thomasmulder.com has the right to modify, limit and stop this guarantee at any time.
  5. Under no circumstances are results promised, promised or guaranteed by thomasmulder.com. Each User is solely responsible for the application of the content and any result to be achieved.

12.2 Challenge

  1. If the user didn’t make a $500,- (five hundred dollars) in sales within 21 days after starting to advertise using our strategies, the User may file a complaint. In this complaint, the user must prove, with reasons and by producing evidence, that he/she has not achieved the result. By not ‘the result’ is meant: the user has not made $500,- (five hundred dollars) in sales within 21 days after starting to advertise using the strategies that we show in the content.
  2. Any refund of the paid amount will be refunded only if the User has expressly fulfilled all the following conditions stated in article 12.2.3. Thomasmulder.com must access the data it has requested from the User upon first request. If the user refuses to grant access or does not provide access or the requested data within the deadline of 5 working days, the User will not be entitled to a refund of any funds.
  3. If thomasmulder.com has granted access, the following requirements must be (fully) met:

    -The User has fully gone through the content from the 21-Days challenge and documentary evidence shows that this content has been correctly applied by the User.

    -The User tested at least 50 products per week, every product has spent a minimum of $1 (one dollar) per day.

    -The User implements the strategy advised, >1% CTR = run for minimum of 7 days.

    -If the User has tested 100 products after week 2 without having any sales, the User must have scheduled a call with one of our experts. This particular call must have taken place.

    -The user has attended every live-session during the challenge.

  4. If the complaint is insufficiently substantiated, or in thomasmulder.com’s sole judgment there is no reasonable ground for the complaint, the User will not receive a refund. If, in thomasmulder.com’s sole opinion, there is a justified complaint, the User will receive a refund of the money already paid within 10 days. Thomasmulder.com has the right to modify, limit and stop this guarantee at any time.

Article 13 Prohibition

Under no circumstances is the Customer allowed to publish, copy or use Programs and/or other parts of the Platform in any other way that is not within the scope of the Agreement.

Article 14 Confidentiality of Data

Each party guarantees that all data received from the other party that is known or should be known to be of a confidential nature will remain confidential. The Party receiving confidential information shall only use it for the purpose for which it has been provided.

Information is in any case considered confidential if one of the parties has indicated it as such.

Thomasmulder.com cannot be held to the provisions in this article if the disclosure of data to a third party is necessary due to a court order, a legal requirement or for the proper execution of the Agreement.

Article 15 Intellectual property

Thomasmulder.com reserves the rights and powers it is entitled to under the Copyright Act.

Customer guarantees that no rights of third parties oppose making data available to Thomasmulder.com. Customer will indemnify Thomasmulder.com against any action based on the allegation that such provision, use, editing, installation or incorporation infringes any right of third parties.

Article 16 Complaints

If Customer has a complaint Customer should send it in writing to support@Thomasmulder.com.nl. Thomasmulder.com will then deal with the complaint as soon as possible.

Article 17 Identity of thomasmulder.com

Thomasmulder.com.com are websites of Pinterest Mastery B.V., which is registered with the KvK under 81637810.

Thomasmulder.com is located at Telderslaan 23, 3527 KD in Utrecht.

Thomasmulder.com can be reached by e-mail at support@thomasmulder.com.

Article 18 Applicable law and competent court

On the legal relationship between Thomasmulder.com and its Customer Dutch law is applicable.

All disputes which may arise between Thomasmulder.com and Customer will be settled by the competent judge of the District of Amsterdam.

Article 19 Maximum pause time for the Unlimited program

Thomasmulder.com is able to end the unlimited program if the Customer stops working on their “e-commerce business” and/or stops communicating with us about their e-commerce business in the personal WhatsApp group for 3 months or more. 

If in any occasion, the customer is not able to work on their e-commerce business due to unforeseen circumstances, they will have to communicate this with thomasmulder.com within at least 4 weeks after the occurrence of the event which makes it impossible for the customer to work further on their e-commerce business. Thomasmulder.com will decide whether the circumstances are sufficiently far-reaching. 

If thomasmulder.com decides the circumstances of the customer are not sufficiently far-reaching, then the maximum pause time will stay 3 months. The customer can stay inactive for 3 months in total. 

For example: Customer X had a 1-month pause without reasonable explanation and/or notice, 3 months later Customer X had a 2-month pause without reasonable explanation and/or notice. Customer X has now surpassed the maximum in pause time and can now be denied from further coaching from thomasmulder.com

If the information necessary for the execution of the Agreement is not provided to Thomasmulder.com in time, Thomasmulder.com has the right to suspend the execution of the Agreement.

If thomasmulder.com has granted access, the following requirements must be (fully) met: -The User has fully gone through the content from the course and documentary evidence shows that this content has been correctly applied by the User. -The User has attended at least two group coaching sessions in the first 30 days. -The User has spent at least 500 euro on marketing activities (Pinterest Ads).
  4. If the complaint is insufficiently substantiated, or in thomasmulder.com’s sole judgment there is no reasonable ground for the complaint, the User will not receive a refund. If, in thomasmulder.com’s sole opinion, there is a justified complaint, the User will receive a refund of the money already paid within 10 days. Thomasmulder.com has the right to modify, limit and stop this guarantee at any time.
  5. Under no circumstances are results promised, promised or guaranteed by thomasmulder.com. Each User is solely responsible for the application of the content and any result to be achieved.

12.2 Challenge

  1. If the user didn’t make a $500,- (five hundred dollars) in sales within 21 days after starting to advertise using our strategies, the User may file a complaint. In this complaint, the user must prove, with reasons and by producing evidence, that he/she has not achieved the result. By not ‘the result’ is meant: the user has not made $500,- (five hundred dollars) in sales within 21 days after starting to advertise using the strategies that we show in the content.
  2. Any refund of the paid amount will be refunded only if the User has expressly fulfilled all the following conditions stated in article 12.2.3. Thomasmulder.com must access the data it has requested from the User upon first request. If the user refuses to grant access or does not provide access or the requested data within the deadline of 5 working days, the User will not be entitled to a refund of any funds.
  3. If thomasmulder.com has granted access, the following requirements must be (fully) met:

    -The User has fully gone through the content from the 21-Days challenge and documentary evidence shows that this content has been correctly applied by the User.

    -The User tested at least 50 products per week, every product has spent a minimum of $1 (one dollar) per day.

    -The User implements the strategy advised, >1% CTR = run for minimum of 7 days.

    -If the User has tested 100 products after week 2 without having any sales, the User must have scheduled a call with one of our experts. This particular call must have taken place.

    -The user has attended every live-session during the challenge.

  4. If the complaint is insufficiently substantiated, or in thomasmulder.com’s sole judgment there is no reasonable ground for the complaint, the User will not receive a refund. If, in thomasmulder.com’s sole opinion, there is a justified complaint, the User will receive a refund of the money already paid within 10 days. Thomasmulder.com has the right to modify, limit and stop this guarantee at any time.

12.3 Sale guarantee

  1. If the student didn’t make a sale within the first 7 days of the coaching period, the student can request a compensation for their invested time. The compensation amount is $1000,-. This compensation can only be requested if the student meets all of the following requirements:
    1. You’ve watched all the videos in the course.
    2. You are on schedule of everything inside the course and you’ve started advertising your first product maximum on the 2nd day of the challenge
    3. You have attended all 7 daily live sessions from start to end
    4. You store contains the following elements:
      – Sticky add to cart
      – header checkmark bar
      – checkmarks between title and add to cart button
      – payment icons
    5. Your store had creditcard and paypal enabled as payment options for your customers at least from moment you started advertising until the end of the 7-day challenge
    6. Your store is accessible for all visitors of the country that is targeted in your ad campaigns and all visitors must be able to make a purchase on your store
    7. The store that is targeted in your ad campaigns is the same as the store you’ve stared in the 7-day challenge
    8. You have done at least one optimization for every product above 1% CTR at least 24 hours after the advertising campaign for that product was launched
    9. You have launched ad campaigns for at least 10 products before day 4 and at least 20 products in total before day 6
    10. Of the minimum 20 products you have tested at least 8 were products that were suggested in the live sessions
    11. You’re responsible for delivering proof that you have met all the above requirements. Within that proof there need to proof of what all landing pages and ad campaigns looked like of every single day. Any claim of no success and therefor the right on a compensation without proof that all requirements are met will not be paid.

Article 13 Prohibition

Under no circumstances is the Customer allowed to publish, copy or use Programs and/or other parts of the Platform in any other way that is not within the scope of the Agreement.

Article 14 Confidentiality of Data

Each party guarantees that all data received from the other party that is known or should be known to be of a confidential nature will remain confidential. The Party receiving confidential information shall only use it for the purpose for which it has been provided.

Information is in any case considered confidential if one of the parties has indicated it as such.

Thomasmulder.com cannot be held to the provisions in this article if the disclosure of data to a third party is necessary due to a court order, a legal requirement or for the proper execution of the Agreement.

Article 15 Intellectual property

Thomasmulder.com reserves the rights and powers it is entitled to under the Copyright Act.

Customer guarantees that no rights of third parties oppose making data available to Thomasmulder.com. Customer will indemnify Thomasmulder.com against any action based on the allegation that such provision, use, editing, installation or incorporation infringes any right of third parties.

Article 16 Complaints

If Customer has a complaint Customer should send it in writing to support@Thomasmulder.com.nl. Thomasmulder.com will then deal with the complaint as soon as possible.

Article 17 Identity of thomasmulder.com

Thomasmulder.com.com are websites of Pinterest Mastery B.V., which is registered with the KvK under 81637810.

Thomasmulder.com is located at Telderslaan 23, 3527 KD in Utrecht.

Article 18 Applicable law and competent court

On the legal relationship between Thomasmulder.com and its Customer Dutch law is applicable.

All disputes which may arise between Thomasmulder.com and Customer will be settled by the competent judge of the District of Amsterdam.

Article 19 Maximum pause time for the Unlimited program

Thomasmulder.com is able to end the unlimited program if the Customer stops working on their “e-commerce business” and/or stops communicating with us about their e-commerce business in the personal WhatsApp group for 3 months or more. 

If in any occasion, the customer is not able to work on their e-commerce business due to unforeseen circumstances, they will have to communicate this with thomasmulder.com within at least 4 weeks after the occurrence of the event which makes it impossible for the customer to work further on their e-commerce business. Thomasmulder.com will decide whether the circumstances are sufficiently far-reaching. 

If thomasmulder.com decides the circumstances of the customer are not sufficiently far-reaching, then the maximum pause time will stay 3 months. The customer can stay inactive for 3 months in total. 

For example: Customer X had a 1-month pause without reasonable explanation and/or notice, 3 months later Customer X had a 2-month pause without reasonable explanation and/or notice. Customer X has now surpassed the maximum in pause time and can now be denied from further coaching from thomasmulder.com
